1. Agreement
These terms are a binding agreement between you and FlexTPM LLC ("FlexTPM", "we", "us"). By purchasing, downloading, or installing FlexTPM ("the Software"), you agree to these terms. If you do not agree, do not use the Software.
2. License
FlexTPM grants you a limited, non-exclusive, non-transferable license to install and use the Software on the number of machines covered by your license tier.
- Personal: 1 machine.
- Pro: up to 3 machines, priority support.
- Studio: up to 5 machines, all future updates, priority support.
Licenses are hardware-locked and cannot be transferred to other machines. A new license is required for each additional machine beyond your tier. The Studio tier includes all future feature updates at no additional cost.
3. Restrictions
You may not:
- Redistribute, resell, sublicense, or share the Software or license keys.
- Reverse engineer, decompile, or disassemble the Software.
- Modify or create derivative works based on the Software.
- Circumvent or disable license enforcement or security features.
- Use the Software for any unlawful purpose.
4. Beta and Trial Software
Beta and trial versions are provided for evaluation. They may contain bugs, expire automatically, and FlexTPM may terminate access at any time. You agree not to publicly benchmark, review, or share performance data without permission.
5. Disclaimer of Warranties
The Software is provided "as is" without warranty of any kind. FlexTPM does not warrant that the Software will be error-free, uninterrupted, or compatible with all hardware configurations. You use the Software at your own risk.
6. Limitation of Liability
FlexTPM is not liable for any damages arising from the use or inability to use the Software, including but not limited to data loss, system instability, hardware issues, or business interruption. This applies even if FlexTPM has been advised of the possibility of such damages.
7. System Modifications
The Software installs device drivers, creates system services, and modifies system configuration. A reboot is required after installation. You are responsible for maintaining backups of your data before and during use.
8. Refunds
All sales are final except where a refund is expressly granted under this section.
A refund may be requested within 3 days of purchase only if all of the following conditions are met:
- The Software cannot be installed, cannot activate, or does not present a working TPM 2.0 device on your system.
- You have contacted [email protected] with your license key, system details, and installer logs, and have completed reasonable troubleshooting steps provided by support.
- The issue could not be resolved by support.
Refunds will not be granted in any of the following cases:
- Change of mind, duplicate purchase, or no-longer-needed purchase.
- Incompatibility with, or rejection by, any third-party software that performs checks beyond the standard Windows TPM 2.0 interface, including but not limited to games, DRM, and platform integrity systems. FlexTPM is sold as a TPM 2.0 driver and makes no guarantee that any specific third-party application will accept it.
- Systems that do not meet the listed requirements, including Apple Silicon Macs, non-x86-64 hardware, and operating systems other than supported Windows versions.
- Issues caused by user modification of the Software or system, conflicting third-party software, failure to follow installation instructions, or inability or refusal to reboot.
- Successful installation followed by uninstallation for reasons unrelated to Software malfunction.
- Requests made more than 3 days after purchase.
- Accounts with prior refunds, or purchases made after a prior refund on the same hardware or billing identity.
Chargebacks filed without first contacting support are considered a breach of these terms and will result in permanent revocation of the license and a permanent ban from future purchases.
If a refund is issued, your license is permanently revoked and you must uninstall the Software from all machines. FlexTPM reserves the right to verify deactivation before processing the refund.
9. Termination
FlexTPM may revoke your license if you violate these terms. Upon termination, you must uninstall the Software and destroy all copies.
10. Governing Law
These terms are governed by the laws of the State of Texas.
